Terms of Service
From service agreements to digital interactions, our terms define the guidelines, responsibilities and conditions that shape how you use our website and services.
Effective Date: 10 October 2026
These Terms of Service establish the conditions under which WebCreateHub provides access to its website and delivers digital services to clients.
By accessing our website or proceeding with a project proposal, you agree to the terms applicable to your use of the website or the services you purchase. Individual projects may also be governed by a separate quotation, statement of work, or written agreement.
About WebCreateHub
WebCreateHub is a digital services business offering solutions such as website creation, e-commerce implementation, CMS customization, graphic design, digital marketing, technical improvements, and related online business services.
The exact services provided to a client depend on the scope and deliverables confirmed for that engagement.
How a Project Is Established
Before work begins, the parties should establish the intended deliverables, project cost, payment arrangements, estimated schedule, and any specific requirements.
A project may be confirmed through an accepted proposal, written approval, or another mutually agreed method.
Work requested beyond the confirmed scope may require additional fees or a revised delivery schedule. We will communicate material changes before proceeding with additional chargeable work.
Responsibilities During an Engagement
A successful project requires cooperation from both sides.
WebCreateHub will undertake the agreed work with reasonable professional care. The client is expected to supply accurate information, provide necessary access, arrange required third-party accounts, review deliverables, and communicate decisions within reasonable timeframes.
The client must also ensure that any supplied text, photographs, branding, software, or other materials are authorized for use.
If required information or approvals are delayed, project milestones may need to be rescheduled.
Fees and Payment Arrangements
The financial terms of each engagement will be documented in the relevant proposal, quotation, or invoice.
Clients must pay the agreed amounts by the specified due dates. Advance payments, milestone payments, recurring charges, taxes, and any additional costs will be handled according to the applicable agreement.
If payment remains outstanding, WebCreateHub may pause affected work after appropriate notice, subject to the contract and applicable law. Any resulting schedule changes will be communicated where reasonably practicable.
Work outside the agreed scope must be approved before additional charges are incurred.
Delivery, Reviews, and Changes
Project schedules are estimates based on the confirmed scope, available resources, and timely cooperation from the client.
Designs, website functionality, and other deliverables should be reviewed against the agreed requirements. Any included revision rounds will be governed by the relevant proposal.
A request to change an approved design, add new functionality, introduce additional pages, or alter the original requirements may be treated as a scope change.
If an issue is reported, we will assess it against the agreed specifications and determine the appropriate next steps.
Rights to Work and Creative Materials
Each party retains the rights it already owns.
Clients retain ownership of their original business materials, branding, content, and other assets they supply, subject to any third-party rights.
Ownership of specifically commissioned final deliverables will be governed by the applicable project agreement. Where no different arrangement has been agreed, ownership transfer of eligible custom deliverables will take effect after full payment.
WebCreateHub retains rights in its pre-existing tools, reusable code, internal methods, generic components, and development know-how unless expressly transferred in writing.
Software libraries, plugins, fonts, stock assets, themes, and other third-party materials remain subject to their respective licence conditions.
Use of Our Website
Visitors may use our website for lawful browsing, enquiries, and learning about our services.
You must not attempt to disrupt its operation, access restricted systems without authorization, distribute harmful code, impersonate another person, or reproduce protected website material without permission.
We may modify, maintain, restrict, or discontinue parts of the website when reasonably necessary for operational, security, or business reasons.
Third-Party Platforms and Expenses
Some projects depend on independently operated services, including hosting companies, domain registrars, CMS platforms, payment gateways, plugins, APIs, and advertising networks.
Unless expressly included in the project scope, charges for those services are the client’s responsibility.
WebCreateHub cannot control external providers’ pricing, availability, account decisions, licensing requirements, or policy changes. We are not responsible for failures attributable to third-party services beyond our reasonable control, subject to applicable law and any specific commitments in the project agreement.
Confidential Business Information
Information exchanged for a project should be used only for appropriate business purposes.
Both parties should take reasonable precautions to protect confidential information and avoid disclosing it to unauthorized individuals. Information may be disclosed where legally required or where disclosure has otherwise been authorized.
Clients should use secure account permissions and avoid sharing credentials beyond what is necessary for the work.
Quality, Results, and Service Limitations
We aim to provide solutions that meet the agreed project requirements. However, the performance of websites and marketing activities can depend on factors outside our control.
Unless specifically agreed in writing, WebCreateHub does not guarantee particular search engine positions, sales figures, advertising returns, visitor numbers, uninterrupted website availability, or complete freedom from technical errors.
Ongoing maintenance, backups, security monitoring, and support are included only where expressly covered by the applicable service arrangement.
Suspension and Ending a Service
A service may be ended according to the termination provisions in the relevant agreement.
WebCreateHub may suspend or discontinue affected services where necessary because of a material breach, non-payment, misuse of systems, unlawful activity, or another legitimate reason permitted by the agreement and law.
Where appropriate, the parties will be given an opportunity to resolve the issue before termination.
Outstanding payment obligations and the treatment of completed work upon cancellation will be determined under the applicable agreement and our Refund and Cancellation Policy.
Responsibility for Claims and Losses
Each party is responsible for its own actions and obligations under the applicable agreement.
To the extent permitted by law, WebCreateHub will not be liable for indirect or consequential losses, including lost profits, missed business opportunities, or losses caused by third-party disruptions.
Nothing in these terms excludes liability where exclusion is prohibited by law. Any additional allocation of risk must be set out in the applicable written agreement.
Events Beyond Reasonable Control
Events such as natural disasters, government restrictions, widespread internet failures, infrastructure disruptions, or major third-party outages may affect service delivery.
Where such an event materially affects a project, the parties should communicate and agree on reasonable next steps, subject to their agreement and applicable law.
Disputes and Applicable Law
The parties should first attempt to resolve disagreements through direct communication and a reasonable effort to reach a mutually acceptable outcome.
These terms are governed by the laws of India. Subject to applicable law, disputes will be handled by the competent courts in Kolhapur, Maharashtra, India.
Changes to These Terms
We may update these Terms of Service when our operations, service offerings, or legal obligations change.
The current version will be available on our website. Changes to an existing project agreement will be governed by the terms applicable to that agreement and any mutually accepted amendments.
